Guardianship Order

Hi all,

I have applied to have Public Guardian to care for my 42 yo son. He has Schizoaffective disorder and has an addiction. I want to withdraw the application but NCAT has told me I cannot. I have realised that I am frightened to go on with it, as I know he will harass me when he knows I applied.  I have seen his anger and he is so very unwell, unmedicated, using drugs. Does anyone know how I could rescind the application?

I cannot say I have experienced this myself. Did they explain why they cannot withdraw it?

Also, isn't there a hearing first @Lee5 ?

 

Perhaps in the hearing, you can share that you want to do it to support him, but you are afraid of the repurcussions? As I said, I really don't know because I'm not expert in this. These are only my thoughts.

 

Also, with the guardianship order, from what I do know, they still want to ensure the person has a say in the least restrictive manner - right?

Thanks for your thoughts. Yes, there would be a hearing but by then he will know I submitted the application and that is my fear. He needs it but I  know how he will react.  His father applied for financial order some years ago and life was extremely difficult after that. Now his condition has deteriorated, and I have witnessed his anger, I am frightened. I also have a stress related heart issue, just can't face anymore.
